The petitioner seeks direction against respondent Nos. 3 to 5 to hold the elections of all the Primary Agricultural Societies in Sengaon taluka prior to the election of Agricultural Produce Market Committee, (for short '

APMC') Sengaon. APMC Sengaon is not party.

It is not disputed that more than 55% Primary Agricultural Societies are due for election.

We have under our order dated 18th November, 2021 in Writ Petition No.11669/2021 with connected writ petitions have recorded the stand of the Government and observed that in cases

WP No.12471/21 where the term of the majority of the Primary Agricultural Societies is over and they would be deprived from participating in the election of APMC, in such cases, the election of the Primary Agricultural Societies shall be undertaken firstly. It was also stated that in phase-wise manner the process of election of Primary Agricultural Societies has been undertaken.

Pursuant to the said judgment, on 22nd of November, 2021, the State Co-operative Election Authority has issued general direction thereby the process of preparation of voters list of APMC has been cancelled.
