PER COURT :- It is informed that the petitioner is dead. The petitioner is stated to be the guarantor in respect of the loan advanced to respondent - original borrower and is challenging to the proceeding for recovery initiated under section 101 of the Maharashtra Cooperative Societies Act being proceeding No.286/2012. Since the petitioner is dead, the instant petition is rendered infructuous. Keeping the option of the legal heirs of petitioner open to raise an appropriate challenge, if any occasion arises, the writ petition is disposed of.
