The Petitioners/ original Defendants are aggrieved by the interlocutory order dated 01.07.2016 by which, the Trial Court has clamped injunction upon these Petitioners not to disturb the possession of the Plaintiff.

The Petitioners are also aggrieved by the judgment of the Appellate Court dated 14.08.2018 by which, Miscellaneous Civil Appeal No.45/2016 has been dismissed.

At this juncture, the learned Advocate for the Petitioners submits, on instructions, that this petition may be disposed of as withdrawn, but the Trial Court may be directed to complete the trial in the suit expeditiously as two witnesses of the Plaintiff have already been examined and the Petitioners have also tendered their list of witnesses.
