Present application has been filed for condonation of delay of 127 days in preferring the appeal. Appellant is the original accused in Sessions Case No.40 of 2020 who has been held guilty of committing offence punishable under Section 302 of the Indian Penal Code and has been awarded imprisonment for life and to pay fine of Rs.10,000/-, in default to suffer simple imprisonment for one month, by the learned Additional Sessions Judge, Nandurbar on 4th January 2022.

It appears that the appellant is illiterate rustic person and was required to approach the Legal Aid Committee of this Court due to financial constrains. Under such circumstance, for the reasons stated in the application, the delay stands condoned. Application stands allowed and disposed of.
