This is an application for granting regular bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The Applicant is arrested in Crime No.0198 of 2025 dated 26th May 2025, registered with Bhadgaon Police Station, Taluka Bhadgaon, District Jalgaon, for the offence punishable under Sections 64 and 69 of Bharatiya Nyaya Sanhita, 2023.

Learned Advocate for the Applicant pointed out that, as per the report, the prosecutrix is 19 years of age. The Applicant had proposed marriage to her, and thereafter, she packed her clothes and

2 of 3 975-BA.1764.2025.odt voluntarily accompanied him. Subsequently, sexual intercourse took place between them. Thereafter, the report came to be lodged against the Applicant.

Learned Advocate for the Applicant further submitted that the incident, at the most, reflects a consensual sexual relationship arising out of mutual affection between the Applicant and the Informant. It is, therefore, prayed that the Applicant be released on bail.

Learned APP for the Respondent-State strongly opposed the application and submitted that no case is made out for grant of bail. It is, therefore, prayed that the application be rejected. 6.

Perused the charge-sheet, particularly the report and statements of the witnesses. The Informant-prosecutrix is 19 years of age. Considering the overall circumstances and material on record, the application deserves to be allowed.

In view of the above, the application is allowed in the following terms :

a] The Applicant shall be released on bail in connection with FIR No.0198 of 2025 dated 26th May 2025, registered with Bhadgaon Police Station, Taluka Bhadgaon, District Jalgaon, on furnishing PR bond of

3 of 3 975-BA.1764.2025.odt Rs.15,000/- with one or two sureties in the like amount to the satisfaction of the trial Court.

b] The Applicant shall not tamper with the evidence of the prosecution and he shall not influence the informant, witnesses and other persons concerned with the case. 8.

The application stands disposed of.
