The Petitioner is a male teacher. Yet, he submits that, because he had earlier worked in a hard area, he should not be posted again in such area.

The learned Advocate for the Zilla Parishad submits that, these provisions are directory in nature, whereby a person who has worked in a hard area for a term of five years, can be transferred to an easy area considering his seniority. 3.

His earlier tenure was in the Primary School, Ramwadi (Kanse) which was not a difficult area and presently, he

11197.23WP (2) has been transferred to the Zilla Parishad School, Jamdi in Kannad Taluka. This area is also not declared as hilly/difficult area.

As such, this Writ Petition is dismissed.
