Though the matter is circulated for urgent admission, the advocate for the petitioner is absent. The petitioner is assailing the order of the tribunal dismissing the original application.

The learned AGP relies on the judgment of the Apex Court in the case of Union of India Vs. Bakshi Ram (1990(2) SCC 426) to submit that even if the person is granted benefit under the Probation of Offenders Act, the conviction still subsists.

The

2611.17wp conviction remains untouched and the stigma of conviction is not obliterated.
