Present petition has been filed for following reliefs :- "B.
The respondents may kindly be directed to pay benefit of 5th Pay Commission and revised pay scale of [1]
Rs.4000-6000/- meant for laboratory Assistant w.e.f. 01.01.1996 to petitioners.
C.
Respondents may kindly be directed to give the pay grade in 6th pay Commission and pay level as per 7th pay commission.
D.
By way of issuing writ of mandamus or any other writ, order or directions in the nature of writ of mandamus the respondents be directed to pay the arrears on the corrected pay scale within 60 days or within such stipulated period this Hon'ble Court deem fit." 2.
Learned Advocate for the petitioner relies on the Coordinate Bench decision of this Court at Principal Seat in Dr. Prabhakar s/o Vilasrao Shinde and others Vs. The State of Maharashtra and others, [Writ Petition No.5093 of 2022 decided on 17.04.2025], whereby the petition filed by the similarly situated Lab Assistants was allowed. In that case, reliance was placed on the order dated 24.08.2022 passed by the Hon'ble Supreme Court in State of Maharashtra and Another Vs. Sanjay and Ors., [Special Leave to Appeal (C) No.8707 of 2023]. 3.
Learned AGP, after waiving notice for all the respondents, submits copy of the Government Resolution dated 22.09.2025, which is taken on record by marking as Exhibit-'X', wherein note of the decisions of this Court as well as Hon'ble Supreme Court appears to have been taken and the 5th pay commission has been made applicable. Under such [2]
circumstance, the learned Advocate for the petitioners submits that the purpose of the petition has been served.
