CORAM :

S. V. GANGAPURWALA AND A. I. S. CHEEMA, JJ.

DATE : 09TH MARCH, 2016.

PER COURT :- 1.

Mr. Nagarsoje, the learned counsel states that, in spite of the fact that all documents were filed on record the Committee has remanded the matters back to the S. D. O. In fact, the Committee ought to have decided the same on its own merits. There was no reason to remand the matters back. The learned counsel submits that, in spite of the fact that the orders of remand are dated 04th October, 2014, as yet the records have not been sent to the S. D. O. nor any steps are taken. 2.

The learned A. G. P. states that, considering the merit of the matters the orders have been passed by the Committee. The

2 WP2152.16 petitioners may approach the S. D. O. for getting the matters decided.

3.

We have considered the submissions.

4.

The orders impugned in the present writ petitions are of October 2014. The petitioners could have taken steps by this time to get their matters decided by the S. D. O. However, approached this Court after lapse of one year of the said order being passed. As the orders have been passed in October, 2014 and the said orders are of remand we are not considering the matters on merit. The S. D. O. Sillod to whom the matters are remitted by the Committee shall decide the application of the petitioners for grant of Tribe Certificates expeditiously and preferably within three (3) months. In case, the records are still with the Committee the Committee shall forward the said records with the S. D. O. immediately. The petitioners shall appear before the S. D. O., Sillod on 30th March, 2016.

5.
