Learned counsel for the respondent-original claimant submits that the respondent-original claimant has also preferred appeal for enhancement of compensation, bearing first appeal No. 1666 of 2009 and after admission, the same is pending.

In view of this, learned A.G.P. submits that since appeal preferred by respondent-original claimant is admitted by this Court, delay occurred in filing this appeal may kindly be condoned. Learned A.G.P. submits that even though the proposal for filing appeal was sent to the Law and Judiciary department in time, the department took time to scrutinize the said proposal and delay has been occurred in preferring the appeal.

In view of above submissions and for the reasons stated in the application, I am inclined to condone the delay. Civil application is allowed in terms of prayer clause "B" and disposed of accordingly. ( V. K. JADHAV, J.) rlj/
