O R D E R

(09th SEPTEMBER, 2023) 1.

This appeal is placed before us in today's National Lok Adalat. Mr. Mayure, learned advocate for the appellants is present. Mr.Phule, AGP for the respondents/State is present. 2.

The learned advocates for the parties submit that they have amicably settled the lis and accordingly placed on record the compromise terms. The compromise terms dated 09-09-2023 is marked as Article 'X' for the purpose of identification. 3.

The appeal is disposed off in terms of compromise terms ' X'

As per the compromise terms respondent No.2-Insurance Company is ready to deposit enhanced compensation amount of Rs.3,00,000/- in addition to the award passed by the tribunal in MACP No.271/2011 as full and final settlement inclusive cost, interest etc within 45 days from the date of receipt of award passed by the National Lok Adalat before the MACT, Parbhani.

The appellants/original claimants are entitled to withdraw amount of compensation as per modified award and learned Member, MACT, Parbhani shall pass necessary orders to that effect forthwith. 6.

The appellants are ready to deposit deficit court fees within a period of three weeks from the date of receipt of certified copy of award.

7.

The Chairman/Member, Motor Accident Claims Tribunal, Parbhani, be informed accordingly.

8.

The Court Fee refund certificate be issued as per the provisions under the Maharashtra Court Fees, Act, 1959. 9.
