IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 10 WRIT PETITION NO.10955 OF 2023 DR ADINATH BABURAO CHEDE AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND OTHERS ...

Advocate for Petitioners : Mr. Hon Ashwin Vinayak AGP for Respondents-State : Mr. K. B. Jadhavar ...

CORAM :

ARUN R. PEDNEKER, J.

DATE :

04/09/2023 PER COURT :

Heard the learned Advocate representing the parties. The learned Advocate for petitioners submits that the Revision Application is filed before the Hon'ble Minister under Section 154 of the Maharashtra Co-operative Societies Act, 1960 on 03/08/2023 along with a prayer for interim relief. However, the learned Advocate for the petitioners submits that the Minister has not taken up the matter for hearing and that their property in the interregnum is being attached by the authority and his petition before the Hon'ble Minister will be rendered infructuous.

2.

He thus submits that during the pendency of the proceeding before the Minister, this Court may pass an appropriate interim order.

WP 10955-2023 3.

Instead of this Court entertaining the matter, it is directed that the Hon'ble Minister concerned to take up the prayer for interim relief within a period of two weeks from the date fixed for appearance before the Minister i.e. 08/09/2023. 4.

The parties are permitted to appear before the Hon'ble Minister on 08/09/2023, so as to enable the Minister to fix the matter for hearing on interim relief.

5.

With the above observations, the present writ petition is disposed of.

6.

In the event, if the matter is not taken up for consideration for interim relief within a period of two weeks from the receipt of the order of this Court, liberty is granted to the petitioners to move this Court afresh.

7.

It is clarified that I have not observed anything on the merits of the matter and the Hon'ble Minister to decide the revision petition in accordance with law, without being influenced by any part of order of this Court.
