IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO.12650 OF 2018 (Baban Govind Gund and another Vs. The State of Maharashtra and others) IN WRIT PETITION NO.8784 OF 2018 Mr.D.R.Jayabhar, Advocate for the applicants. Mr.S.R.Yadav, AGP for respondent No.1.

Mr.N.C.Garud, Advocate for respondent No.2.

( CORAM : Ravindra V.Ghuge, J.) DATE : 12/10/2018 PER COURT :

1.

I have briefly heard the learned Advocates for the respective sides. Mr.Garud, learned Advocate has strenuously prayed that the application be rejected.

2.

It appears from the record that the petitioners are aggrieved by the compromise terms arrived at in the Lokadalat in the Civil Court in RCS No.345/2017. The petitioners claimed to be the protected tenants who were kept away from the proceedings before the Civil Court and the compromise. The mutation entries have been effected pursuant to the compromise.

3.

In view of the above, this civil application is partly allowed by khs/OCT.2018/12650-d

directing the litigating sides that they would not create third party interest or encumbrances in the property at issue until further orders.

4.

List the writ petition for admission on 21/11/2018. ( Ravindra V.Ghuge, J.) khs/OCT.2018/12650-d
