At the outset, a preliminary objection is raised on behalf of the respondent, with regard to the jurisdiction of this Bench, to take up the present petition, in the light of the admitted position that the petitioner passed her M.B.B.S. course from respondent no. 3 - College, which is located in Solapur.

We find substance in the objection raised on behalf of the respondent.

The nature of cause of action arising in the present petition indicates that, such a petition ought to be filed before the Circuit Bench of this High Court at Kolhapur.

In this backdrop, learned Senior Counsel for the petitioner, on instructions, seeks permission to withdraw the petition, with liberty to approach the Circuit Bench of this High Court at Kolhapur. 5.

The petition is disposed of as withdran with liberty, as prayed for.
