1] We have heard learned counsel for the petitioners and learned AGP.

2] The petitioners have not deposited the amount at the time of withdrawing the compensation. The land is acquired in the year 1964. For the first time time, application is made in the year 2009 for allotment of land. The application is rejected on the ground that occupancy price is not deposited.

3] The land was also not acquired from the petitioners. It is submitted that in the year 1964 the same was acquired from the father and grand father of the petitioners. During their lifetime, they had not claimed any such alternate land.

66.22WP 4] The petitioners have withdrawn the compensation amount. The petitioners have not deposited occupancy price for more than 35 to 38 years and after more than 35 to 38 years, the application is made and now it is submitted that when the application was made the petitioners showed their willingness to deposit the amount, still no amount is deposited.

5] In the light of that, this Court cannot come to the aid of the petitioners. Writ Petition is disposed of. [S.G.DIGE, J.] [S.V.GANGAPURWALA, J.] DDC
