1] Heard learned counsel for the parties.
2] By this civil application, the applicant seeks amendment to the writ petition, which is not yet admitted by this Court.
3] Learned counsel appearing for the respondents have no objection if the amendment is permitted, however, they submit that they do not admit the correctness of the averments made in the application for amendment.
CA 830/17 in WP 3906/10 - 2 - 4] Statement is accepted.
5] Civil application is allowed and made absolute in terms of prayer clause (A) and disposed of. Amendment be carried out within one week from today. Amended copy of the petition shall be served on the other side within one week from the date of carrying out amendment. 6] The respondents are permitted to file affidavit in reply within four weeks from the date of service of amended copy of the petition and copy thereof shall be served on the other side simultaneously.
7] Rejoinder, if any, shall be filed by the applicant / petitioner within two weeks from the date of service of affidavit in reply by the respondents.
8] Place Writ Petition No.3906/2010 on Board for admission on 22.11.2017.
9] Civil application is disposed of in aforesaid terms. No order as to costs.
