CORAM :ARUN R. PEDNEKER, J.
DATE :12th SEPTEMBER, 2023 PER COURT:
1.
The present first appeals are filed by the acquiring body along with applications for stay. Ad interim stay was granted subject to deposit of 100% of the compensation amount as directed by the reference court. However, the acquiring body till date has only deposited 75% of the amount as directed by this court. The learned counsel for the acquiring body submits that he would deposit remaining 25% within twelve (12) weeks.
2.
Stand over to 19.12.2023 3.
The present civil applications are filed for withdrawal of amount deposited in this court.
3 1001-1003 4.
Having heard the learned counsel for the parties and since increase in the compensation is about three times more, I deem it appropriate to permit the applicants to withdraw 75% of the total compensation amount awarded by the reference court along with accrued interest thereon, subject to the condition that the applicant gives usual undertaking to the satisfaction of the Registrar (Judicial) of this court. The civil applications for withdrawal of amount are disposed of.
