Already a dispute is pending between the parties in respect of their private rights bearing Regular Civil Suit No. 104 of 2016 before the Civil Judge, Junior Division, Beed. It also does appear that petitioners - original defendants have presented their counter-claim against respondents - original plaintiffs.

In the circumstances, grievance raised by the petitioners in the instant petition need not be entertained in extra ordinary writ jurisdiction under Article 226 of the Constitution of India.
