This is an application for restoration of Criminal Application No. 4386/2016. When the present application is called out, none appears for the applicant. Even the matter was not mentioned for keeping it back or for adjournment. In that view of the matter, we do not think that this is a case for recalling of the dismissal order dated 23rd August, 2016 passed by this Court. However, because of the mistake of the Advocate, the applicant should not suffer, on deposit of the cost of Rs. 2000/- (rupees two thousand) by the Advocate within one week from today, the application is allowed.

On deposit of the costs, as directed above, the Criminal Application No. 4386 of 2016 would stand restored. On restoration thereof, the said application be listed for hearing on 19th October, 2016.
