The challenge raised in the petition relates to grant of permission to open Urdu medium secondary school. The proposal was tendered in pursuance to the advertisement issued on 18.08.2014. It is the contention of petitioner that the State has not taken any decision in respect of the proposal tendered in the year 2014. In any case, proposal tendered in the year 2014 need not be taken into consideration for according permission to operate Urdu medium secondary school during the academic year 20172018. It would be open for the petitioner to tender fresh proposal in response to the advertisement or invitation of online proposals by the State Government. It would also be open for the petitioner to claim refund of the scrutiny charges or fees from the State Government, if in the event, the proposal tendered in the year 2014 h as not been dealt with by the State authorities.
