The petitioner has an alternate remedy of filing an appeal before the Registrar General under the provisions of the Maharashtra Money Lending (Regulation) Act, 2014 challenging the order passed by the Divisional Joint Registrar, Cooperative Societies. Therefore, in view of availability of alternate remedy, this petition cannot be entertained.

Mr. P.P. Kalaskar, learned advocate for the petitioner prays for grant of stay to the orders passed by the District Deputy Registrar and Divisional Joint Registrar. However, Mr. S.R. Sapkal, learned advocate for respondent no.3 makes a statement that the sale-deed has already been cancelled and in pursuance of cancellation of the

sale-deed, mutation entry is already effected. He further submits that the petitioner is also availing remedy of filing civil suit in respect of the mutation entry so effected. In view thereof, there is no question of granting any interim relief in favour of the petitioner. 3.

In view of above, the writ petition is dismissed with liberty to the petitioner to file appeal before the Registrar General. ( SANDEEP V. MARNE, J. ) ...
