Learned advocate for the applicant submits that although the applicants are now challenging the order of cognizance passed by the learned Magistrate, the case has already been committed to the Court of Sessions. The charge has not yet been framed. This Court, in Criminal Application No. 2500 of 2023 decided on 07.08.2025, had quashed the proceedings against the co-accused, and the applicant is similarly situated. The applicant would appear before the learned Additional Sessions Judge, Nanded, District Nanded, and would file application for discharge under Section 227 of the Code of Criminal Procedure. Therefore, he seeks withdrawal of the present application with liberty to file an application for discharge before the Additional Sessions Judge, Nanded.
