At the outset, learned Advocate Mr Kale appearing on behalf of appellants undertakes to file death certificate of appellant No.1 within a period of one week.

Appellant No.2 came to be arrested in pursuance of the order of this Court dated 26/08/2025. Presently he is in custody and therefore, learned Advocate for the appellants filed application for suspension of sentence. It is noticed that the appellant No.2 was absent before this Court and therefore, non-bailable warrant by order dated 26/08/2025 came to be issued. The record also shows that the details of sureties also could not be traced. 4.

As the appellant No.2 was already granted bail by suspending his sentence, he can be released, however, by directing to provide fresh bail bond and fresh sureties.

Accordingly, the order dated 26/08/2025 is hereby recalled. The applicant be released on bail by providing fresh P. R. Bond of Rs.15,000/- in the like amount alongwith fresh sureties. [SUSHIL M. GHODESWAR, J.] sjk
