Heard learned advocate for the applicant and learned Additional Public Prosecutor. Perused the papers of investigation. 2.

The applicant is implicated in commission of offence punishable under sections 188, 272, 273, 328 of the Indian Penal Code. Contraband articles were seized from accused Prashant @ Bablu Revannath Shinde. During the course of investigation, the prosecution alleges, that the accused named the applicant as the person from whom he purchased the contraband articles. The said statement disclosing name of the present applicant is recorded on 14th September, 2022. 3.

In spite of lapse of more than one month, no material is

{2} aba1368-22 collected by the Investigating Officer showing involvement of the applicant in the alleged offence. Thus, except statement of the main accused, there is nothing on record to implicate the applicant in the present crime.

The investigation papers do not contain any material showing involvement of the present applicant in the alleged offence. The applicant, therefore, deserves the relief. 5.

The application is allowed. In the event of arrest of the applicant in connection with Crime No.210 of 2022 registered with Neknoor police station for the offence punishable under sections 188, 327, 373, 328 of the Indian Penal Code, he be released on his executing PR Bond and SB of Rs.15,000/- with one surety in the like amount. The applicant shall attend concerned police station everyday from 1st to 7th November, 2022 between 9.00 and 11.00 am.
