Heard learned advocate for the applicant and learned Additional Public Prosecutor. Perused the investigation papers. 2.
The applicant apprehends his arrest in Crime No.603 of 2022 registered with Taluka Jalna police station, for the offence punishable under sections 271, 368, 420, 467 of the Indian Penal Code.

It is prosecution case that the applicant presented a fabricated letter containing bogus seal/stamp of Tahsil Office and Tahsildar Jalna and forged signature of Tahsildar Jalna. By the said letter, the Tahsildar has asked the police station
{2} aba1370-22 authorities to release Hayva Truck bearing registration No. MH21/X-9876. On suspicion, the police enquired about the said letter and it was revealed that the letter was fabricated and bogus seal and stamp were put on the said letter. Accordingly, the Tahsildar has lodged the FIR in question against the applicant.

Learned advocate for the applicant strenuously submitted that there is 9 days' delay in lodging the FIR and that the vehicle, which was to be released pursuant to the said letter, does not belong to the applicant and the applicant has no role to play in the entire case.

Perusal of the investigation papers reveals that the applicant has presented the forged and fabricated letter in the police station. Custodial interrogation is therefore, necessary for effective investigation. This is not a case to exercise discretion in favour of the applicant. The application is, therefore, dismissed. [NITIN B.
