1] The petitioner is challenging the order dated 30.09.2021 passed by the Additional Commissioner, Aurangabad whereby the order dated 13.10.2020 passed by the Additional Collector, Ambajogai and the order dated 06.08.2016 passed by the Sub Divisional Officer, Ambajogai are quashed and set aside. The present proceedings relate to the mutation entry for recording the name of the petitioner on the basis of partition deed. The respondents have also filed suit qua the same property which has been decreed by the appellate authority, however, in Second appeal No.500

12997.21WP of 2017 this Court has issued notices to the respondents therein and has stayed execution of the order passed by the Civil Court in Regular Civil Suit No. 60/2010 before the Civil Judge Junior Division, Ambajogai, District Beed. 2] In view of above, I do not see any reason to entertain this petition and the mutation entry made in the revenue record will be subject to the outcome of the Second appeal No.500 of 2017 pending before this Court. 3] In view of the above, nothing survives in this petition and the same is disposed of in above terms.
