IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.10834 OF 2022 AMOL SURENDRA SANGOLE

VERSUS

THE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND OTHERS ....

Mr R. B. Ade, Advocate for petitioner;

Mrs R. P. Gaur, A.G.P. for respondent No.1 CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.

DATE : 23rd November, 2022 PER COURT:

1.

Considering the relief sought by the petitioner, we are not required to issue notice to the respondents.

2.

The petitioner contends that, he had applied for a transfer from Jalna and had given four options of Bhandara, Gondiya, Chandrapur and Gadchiroli. Vide order dated 22/08/2022, the Chief Executive Officer, Zilla Parishad, Jalna, issued the transfer order in favour of the petitioner, transferring him to Gadchiroli. The petitioner is very keen and eager to join the place of transfer i.e. Gadchiroli. He, therefore, prays that respondent No.4 / Block Education Officer, who is sitting over the file for relieving the

10834.22wp (2) petitioner, be directed to relieve him from Jalna. His representation to the Headmaster as well as to respondent No.4, is pending.

3.

We find it quite strange that, when the Chief Executive Officer has transferred the petitioner by issuing an order, the Block Education Officer is not relieving him. 4.

In view of the above, this petition is disposed off. Since the petitioner has moved a representation to respondent No.4, dated 26/09/2022, we direct respondent No.4, to consider the said representation in the light of the order of the Chief Executive Officer and issue appropriate orders.

5.

We feel it appropriate to record that we have not expressed any opinion upon the claim of the petitioner. (SANJAY A. DESHMUKH, J.) (RAVINDRA V. GHUGE, J.) sjk
