The learned counsel for the petitioner submits that the petitioner stood retired on 31.03.2006. The benefit of Government Resolution dated 30.10.2009 is not accorded to the petitioner. The learned counsel relies on the judgment of this Court in case of Smt. Savitribai Narsayya Guddapa Vs. The State of Maharashtra and others reported in 2014 (6) All M.R. 175.

We have heard the learned Assistant

2 wp 12865.18 Government Pleader and the learned counsel for the institution.

The learned A.G.P. points out that the judgment of Division Bench of this Court referred to supra has been implemented by the Government by issuing Government Resolution dated 27.12.2018. 4.

In the light of that, the writ petition is disposed of. The respondent - State shall consider the case of the petitioner for payment of revised pension as per the Government Resolution dated 30.10.2009.

The petitioner shall submit representation to that effect with the respondent - State and the respondent - State shall consider the said representation within a period of three

(3) months of its receipt and if found eligible as per the judgment of this Court, shall pay the same expeditiously. No costs.
