Perused the application. The applicant approached this Court in view of the orders of this Court dated 24.02.2022 passed in Bail Application No.89 of 2022, to apply for bail afresh if the trial has not been commenced within six months.

The report of the learned District Judge-2 & Additional Sessions Judge, Dhule reveals that the order granting leave to the accused to file fresh bail application if the trial does not commence within six months was not brought to his notice. However, the case is listed for framing charge on 26.12.2022 as it was already posted. There appears no deliberate delay in commencing the trial. However, the interest of the accused must be protected. Hence, the application is disposed of with a direction to the learned District Judge-2 & Additional Sessions Judge, Dhule to dispose of the case within six months, keeping it for day-to-day. The accused and the prosecution should co-operate with the Court in expeditious disposal of the case.
