Heard the learned advocate for the Petitioner. We have perused the Petition paper book with his assistance. It is undisputed that the surname of the Petitioner is 'Wavale', right from his birth and father's record. His school record carries same surname as Wavale. The Maharashtra State Board of Secondary and Higher Secondary Education has also issued a certificate of S.S.C. Examination to the Petitioner with the surname Wavale. The College record also indicates same surname as Wavale. The National Trade certificate carries same surname as Wavale. The National Trade Certificate (Provisional), Government of Maharashtra, also carries same surname as Wavale. The twist in this case is that, the Petitioner appears to have applied for issuance of a Caste Certificate with the new surname 'Wahule' and was successful in getting the Caste
wp10738.24 -2Certificate with the said surname. Based on the said certificate, he also got the caste validity certificate with the surname 'Wahule'. 2.
Prima facie, we find that the Petitioner has surreptitiously used his surname Wahule while seeking the caste certificate and validity certificate, when undisputedly his surname is Wavale. 3.
We have considered the law laid down by the Full Bench of this court in Janabai Himmatrao Thakur vs. The State of Maharashtra and others (Writ Petition No. 80875 of 2017, decided on 17.10.2019). We do not find that there is any obvious mistake, because the Petitioner, till he became 45 years of age, knew that is surname is Wavale. It is for mysterious reasons that he got his surname changed as Wahule.
