The Petitioner/ original Plaintiff is aggrieved by the judgment and order dated 14.07.2016 delivered by the Appellate Court by which, Miscellaneous Civil Appeal No.50/2015, filed by the Defendant challenging the order granting temporary injunction below Exhibit 5 dated 02.05.2015 in RCS No.810/2014, has been allowed and the said order of temporary injunction has been quashed and set aside. The Trial Court had granted temporary injunction on 02.05.2015, which has been set aside by the impugned judgment. The learned Advocate for the Petitioner/ Plaintiff submits, on instructions, at this juncture, that the Petitioner desires to withdraw this petition and prays for expediting the suit.
