The learned A.P.P. has tendered across Bar the affidavit in reply. The same is taken on record.

In the said affidavit in reply, it is stated that the petitioner has undergone actual imprisonment of 14 years, 4 months and 7 days till 30th September, 2016. It is further stated that the proposal is submitted by the concerned Officer to the State Government on 22nd March, 2016 and the same is pending with the State Government.

We direct the Respondent no.1 to take decision on the pending proposal, if already not taken, as expeditiously as possible and preferably within six weeks from today and communicate the said decision to the petitioner through the Superintendent of Jail. We make it clear that in case, no decision is taken by the respondent no.1 within six weeks from today, we may summon the Secretary to appear before this Court in person.

With the above observations, the Petition is disposed of.

The parties shall act upon authenticated copy of this order.

The learned A.P.P. assures this Court that he would communicate the today's order to the concerned authority by fastest mode of service through the office of Public Prosecutor.
