This application is for condonation of delay of 98 days caused in filing the appeal. The appeal is field challenging judgment and award passed by the learned Member, Motor Accident Claims Tribunal, Ambajogain in M.A.C.P. No. 50/2012. The award is dated 27.03.2015. The appeal is for enhancement in the amount of compensation by the claimants.

The learned advocate for respondent No. 3 opposes the application stating that, no proper reason is given for condonation of delay and prays for dismissal of the application.

Considering that the delay is only of 98 days and the appeal is filed by the claimants, this Court is inclined to allow the application.
