The issue brought before us is a personal fight between the petitioner and his biological brother / respondent No.3. Issue is as regards illegal construction being carried out by one of the brothers. 2.

This litigation purely has trappings of a civil dispute between 2 brothers with regard to the lands. Both are residing adjacent to each other. In this situation, we do not find that the writ jurisdiction of this Court can be exercised. It would be appropriate to relegate the petitioner to the remedy before the Civil Court. 3.
