Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.103 of 2024 registered with Umri Police Station, District Nanded for the offences punishable under Sections 302, 323, 504, 506, 143, 147, 148, 149, 201 r/w 34 of the Indian Penal Code and Sections 4/25 and 27 of the Arms Act.

The prosecution has a case that there was a dispute between the deceased and the accused for pig cutting machine. Therefore, they have committed the murder of the deceased in his field. The prosecution has the circumstances of noting the presence of the accused near the spot of the incident at odd hours, the quarrel before the day of the incident and leaving the village by applicant at odd hours after the incident.

The allegations against the applicant were that he was seen present at late hours at some distance from the place of the incident. Thereafter, he immediately left the village at odd hours. However, except this material, nothing is recovered from him. Therefore, this Court is of the view that his further detention would serve no purpose. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Yeshwant Gangaram Dhuture, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that he should not tamper with the prosecution witnesses and should attend the trial on each and every effective date.
