Heard Mr. Bhavthankar, learned counsel for the applicant. There is delay of 86 days in preferring the appeal by Municipal Council, Ambajogai. The sole respondent is served, but he has not filed reply. Learned Advocate Mr. Bhavthankar submits that, the Chief Officer and the Clerk from Legal Department were transferred and, therefore, there is delay. Considering the ground, the application is allowed. The delay is condoned subject to costs of Rs.2500/- (Rupees two thousand five hundred only), payable to High Court Bar Library within two weeks.
