After hearing the learned counsel for the applicant and the learned A.P.P. for the respondent/State and going through the entire papers and case laws relied upon by the applicant, the Court expressed disinclination to grant bail. The learned counsel for the applicant, on instructions, seeks leave to withdraw the application on the condition that liberty may be granted to the applicant to seek bail after some period, if the trial is not completed. There appears no provision in law to grant such liberty. Change in circumstances is the legal ground to file a fresh bail application. Hence, the Court expressed disinclination to accept the contention. Then, the learned counsel for the applicant sought leave to withdraw the application. Leave granted.
