Heard learned APP. Seen report submitted by the Sub Divisional Police Officer, Kalam to the prosecution wing. 2.

It is reported that 'B' summary report came to be filed on 27.03.2015 in the Court of learned Judicial Magistrate, First Class in respect of the accused as the Police have found that FIR is not true. In view of this development, both the present proceedings have become infructuous. It is up to learned JMFC to take decision on 'B' Summary. If learned JMFC does not accept 'B' summary report and further orders are made, the petitioners are at liberty to come to this Court again. With that liberty, both the petitions are disposed of.
