BENCH AT AURANGABAD CIVIL APPLICATION NO. 4306 OF 2020 IN FIRST APPEAL ST. NO. 29207 OF 2018 Balaji Rajendra Karande & others Applicants

Versus

The State of Maharashtra & others Respondents Mr. A. T. Jadhavar, advocate for the Applicants Mr. B. V. Virdhe, AGP for Respondents No.1 & 2. CORAM : SANDIPKUMAR C. MORE, J.

DATE : 13th June, 2023.

PC :

Heard rival submissions.

The applicants-claimants, are seeking condonation of delay of 1266 days which appears to be caused due to their financial crisis.

The learned AGP for Respondents No. 1 & 2 strongly opposed the application on the ground that the delay is not properly explained and there is also circulation delay. The acquiring body, despite service, remained absent. However, considering the statutory right of the

{2} 960-ca4306.20.odt applicants, delay of 1266 days stands condoned subject to the condition that the applicants shall not claim any interest for the aforesaid period of delay and also for the delay in circulating the matter belatedly.

The appeal be placed for admission after removal of office objections, if any.

Civil Application is disposed of.
