Despite service none appears on behalf of the respondent. 2.

Heard learned advocate for the applicant.

This miscellaneous civil application has been moved for transfer of proceedings bearing HMP No.92 of 2016 pending before Civil Judge, Senior Division, Vaijapur to the court of Civil Judge, Senior Division, Kopargaon.

Learned advocate for the applicant contends that since 2014 the applicant is staying with her mother, she is not being paid maintenance and economic condition of her and her mother is not well. Additionally, a three year child is to be maintained by

{2} mca202-16 the applicant and in the circumstances, it is difficult for her to attend to the proceedings at Vaijapur.

Aforesaid submissions go uncontroverted in the absence of appearance on behalf of the respondent, which to a large extent gives an indication of tacit acceptance of the request made under the miscellaneous civil application for transfer of proceedings from Vaijapur to Kopargaon.
