The matter is settled between the parties. It is a case under Section 498-A of the Indian Penal Code. The informant wife has filed affidavit, giving express consent for allowing the application for quashment of the F.I.R. and the consequential proceedings in R.C.C. No.2539/2019. Learned counsel for the applicants has placed on record copy of the judgment and order granting the parties the decree of divorce under Section 13(1)-B of the Hindu Marriage Act. In view of the same, the application is

allowed in terms of prayer clause (B) and (D-1). The F.I.R. bearing Crime No.0245/2019, registered at Pundlik Nagar Police Station, Aurangabad for the offence punishable under Sections 498-A, 323, 504 read with Section 34 of the Indian Penal Code and the consequential proceedings being R.C.C. No.2539/2019, pending before the learned 14th Judicial Magistrate, First Class, Aurangabad are quashed.

Fees of Ms S.V. Salunke, learned counsel appointed for respondent No.2 is quantified at Rs.6000/- (Rupees six thousand).
