The learned counsel for the petitioners submits that the proposals seeking approval to the transfer of the petitioners from unaided to aided are pending with the respondent. According to the learned counsel for the petitioners, though the proposal is pending with the Education Officer, the Education Officer may send candidates through Shalarth Pranali. The learned counsel submits that transfer from unaided to aided is permissible in view of the judgment of this Court in Writ

3 wp 11237.19+ Petition No. 1493 of 2018 and other connected writ petitions dated 04.07.2019.

The learned A.G.Ps. accept notice for respondents no. 1 to 3 in respective matters. Mr. S. A. Deshpande, learned counsel waives service of notice for respondents no. 4 and 5. 3.

In case the proposals seeking approval to the transfer of the petitioners from unaided to aided post (Exhibit - C, Page - 15/16) are pending with the Education Officer, then the Education Officer shall decide the same on its own merits, in accordance with law, expeditiously and preferably within a period of four (04) months from today. The Education Officer shall consider the judgment referred (supra).

Writ Petitions stand disposed of. No costs.
