Heard. This petition challenges concurrent finding recorded by the Courts below that the petitionerhusband has sufficient source of income to pay meager sum of Rs.3000/- per month as maintenance to respondent-wife. Learned Counsel for the petitioner invited my attention to part of the judgment where learned Magistrate discussed possible source of income of the petitioner. While opposing the application, the petitioner conveniently took a stand that he did not have any business but he is a daily wage earner. As against this, respondent-wife produced on record invitation card of the wedding where the petitioner boasted of three businesses belonging to his family. It is, therefore, clear that
( 2 ) crwp988.13 the defence taken by the petitioner was palpably false. The Courts below appreciated such circumstances correctly that the petitioner has sufficient means to pay at-least Rs.3000/- per month to his respondent-wife. I do not find any error or illegality in such appreciation. 2.
The amount, if any, deposited in the Court shall be handed over to the respondent.

The criminal writ petition stands dismissed.
