The learned advocate for the petitioner submits that the petitioner's proposal is awaiting adjudication at the hands of the respondent/Scrutiny Committee since December 2022 and she is in urgent need of the decision on her proposal to pursue her education. He also submits that vigilance enquiry was conducted at the time of decision in the matter of petitioner's paternal cousin uncle. She has not produced any additional documents. She is ready to respond to the vigilance report in his matter and the Committee be directed to decide the proposal at the earliest. 2.

The learned Assistant Government Pleader on instructions submits that the Committee would need time of three months to

If the petitioner does not produce any additional documents and is ready to accept the vigilance report conducted in the matter of her cousin uncle by name Vilas Uttam Thakur, unless there are specific reasons for the Committee to resort to vigilance enquiry, she can be conveniently permitted to file a reply to that vigilance report and the Committee would thereafter be able to decide the claim in the shortest time possible.

However, we cannot prejudge the matter since it would be for the Committee to consider and decide whether a separate vigilance enquiry is needed.

We dispose of the writ petition by requesting the Committee to permit the petitioner to file reply to the vigilance report conducted in the matter of Vilas Uttam Thakur paternal cousin uncle of the petitioner. If there are no reasons for the committee to resort to fresh vigilance enquiry, it shall make an endeavour to decide the petitioner's proposal finally by 05 September 2023.
