The judgment and order passed by the Tribunal, allowing the Original Application filed by the Respondents is assailed. 3.

The performance of the present Respondent of the examination held by the petitioner in the year 2010 is cancelled. Subsequently, the petitioner is also debarred from appearing in the examination held by the petitioner for further five years. 4.

The examination was pursuant to the advertisement of the year 2010. It is stated that the actual examination is held in 2011. Even if five years are computed from advertisement pursuant to which the selection process is held i.e. 2010, five (5) years have

come to an end.

Considering above, the Writ Petition remains only academic. As such we are not considering the petition on merits. The Writ Petition is disposed of with clarification that henceforth if the petitioner holds examination, the present Respondent would be entitled to appear in the same if otherwise all other eligibility criteria is complied by the Respondent.

The Writ Petition is disposed of. No costs.
