Pursuant to the order dated 12-10-2022, applicant has served RPAD notice on respondent no.1. The applicant has filed affidavit along with packets of RPAD notice issued to respondent no.1, which he has refused to accept.

Applicant seeks modification of the order dated 19-09-2022, whereby this Court continued interim relief for a period of six weeks. According to the applicant, in spite of the fact that, respondent no.1 has superannuated on 30-06-2022, taking undue advantage of continuation of interim relief, he is still continued as in-charge Principal of respondent no.3/college, which is not permissible in law and facts of the present case.

It is made clear that since respondent no.1 has superannuated on 30-06-2022, he is not entitled to continue on the post of in-charge Principal of respondent no.3/college. 4.
