DATE :- 13th September, 2019 Per Court:

Leave to add the Commissioner of Sugar, Maharashtra State, Pune as respondent no.3 in all these civil applications. Addition be carried out forthwith. The learned AGP causes appearance on behalf of the added respondent no.3.

Leave to correct the description of the applicant in Civil Application No.10947/2019. Correction be carried out forthwith. I have heard the learned advocates for the respective sides and the learned AGP.

The procedure for e-tendering after permission being obtained from the Commissioner of Sugar is explained to the court and there is no dispute that the Commissioner of Sugar at Pune will have to pass orders permitting the applicant-liquidator to initiate e-tendering process. After such permission is granted, e-tendering process statutorily requires 45 days. Only thereafter, the concerned amount can be deposited in the court. It is pointed out that the revised proposal from the applicantliquidator is received by the Commissioner of Sugar on 13.08.2019. The learned advocate for the individual employees submits that he has instructions to concede only for extension of 60 days.

*3* Considering the above and in order to ensure that the directions of this Court are complied with, all these civil applications are partly allowed. The Commissioner of Sugar shall accord necessary permission with conditions as are required to be imposed in accordance with law, on or before 30.09.2019. There shall be no extension of time. Thereafter, the applicant-liquidator shall complete the e-tendering process on or before 20.11.2019. Time to deposit the money in the Labour Court will be extended only upto 07.12.2019. The parties shall note that there shall be no further extension of time and they shall act with utmost promptitude.
