The applicant has approached this Court, seeking anticipatory bail in connection with FIR bearing Crime No. 178 of 2025, registered at Azadnagar Police Station, Dhule, for the offences punishable under Sections 118(2), 191(2), 191(3), 190, 115(2), 342, 351(2), 351(3) and 352 of BNS and Sections 37(1)(c) read with Section 135 of the Maharashtra Police Act.

The prosecution case, as emerging from the cross-complaint lodged by the present applicant Siddharth Raju Deore, is that on 11.07.2025 at about 5.30 p.m., when he returned home with his daughter after her class, he found Nana @ Gyansagar Vitthal Salve and others standing outside. They allegedly abused him, pushed him 1/5
to the ground, and Nana attempted to assault him with a weapon, causing an injury to his left leg. On his raising alarm, his mother, pregnant wife, and uncle arrived, but they too were assaulted, and his uncle suffered a head injury. It is further alleged that the accused forcefully entered the house, following which the family defended themselves by using chilli powder, and thereafter proceeded to the police station where they were referred to the District Hospital, Dhule for treatment.

Learned counsel for the applicant submits that the applicant is an injured in the assault committed by the complainant party, and an earlier FIR bearing Crime No. 177/2025 was lodged by the applicant himself, wherein the present complainant of FIR No. 178/2025 is arraigned as Accused No. 1. It is the further submission that the CCTV footage is also available with the police authority, which clearly supports the case in FIR No. 177/2025, in which various offences including attempt to commit murder have been invoked against nana Salve and others.

It is further submitted that the allegations in the FIR would show that the serious allegations are only against Nilesh, who is brother of the applicant and the applicant is deliberately dragged in to have assaulted with the dangerous weapons, whereas the CCTV footage would show that the spot of incident is the house of the 2/5
applicant and the other accused persons in FIR No. 177/2025, had arrived at the house of the applicant and started the quarrel. He therefore, submits that looking to the allegations attributed as against the applicant, the applicant may be protected. 5.
As against this the learned APP submits that the applicant is specifically named in the FIR as one of the assailants who caused injuries to the victim - Vasimkhan Aaubkhan Pathan. The CCTV footage indicates that Vasimkhan has sustained injuries caused by a sharp weapon. Further, another witness, one Mosin Salim Shaikh, has also suffered a contused lacerated wound, in addition to injuries suffered by the complainant - Nana Salve.

The learned APP submits that two earlier cases have been registered against the applicant, and considering his criminal antecedents, he may again indulge in such offences and disturb law and order. He, therefore, seeks rejection of the application. 7.
I have perused the investigation papers pertaining to FIR No. 178/2025, in which the present complainant is also an accused in the earlier counter-FIR No. 177/2025. The CCTV footage is available with the prosecution, which has opposed bail applications of the arrested accused in FIR No. 177/2025, including the complainant - Nana Salve. As seen from the prosecution material, the complainant party has also inflicted injuries upon the applicant, his mother and 3/5
his wife, who was pregnant at the relevant time. The role attributed to the present applicant in FIR No. 178/2025 is limited to causing injuries to Vasimkhan. The principal overt act is attributed to Nilesh, who allegedly injured the complainant - Nana Salve. The injury certificate of Vasimkhan does not reflect any grievous injury. The CCTV footage showing the incident occurring at the applicant's residence also raises doubts regarding the prosecution story in FIR No. 178/2025, particularly in the light of the cross-FIR No. 177/2025 lodged earlier by the applicant.

Insofar as the earlier offences are concerned, one is under Section 354 IPC and the other under Section 324 IPC. In the latter case, the police found no evidence against the applicant and have filed a summary (C-Final) Report bearing NC Final No. 02/2020. The apprehension of the State can very well be taken care of by imposing stringent conditions upon the applicant. Hence, the following order :-
O R D E R
A) In the event of arrest in connection with FIR bearing Crime No. 178 of 2025, registered at Azadnagar Police Station, Dhule, for the offences punishable under Sections 118(2), 191(2), 191(3), 190, 115(2), 342, 351(2), 351(3) and 352 of BNS and Sections 37(1)(c) read with Section 135 of the Maharashtra Police Act, the applicant - Siddharath Alias Nana Raju Deore shall be released on bail on furnishing PR Bond of Rs. 50,000/-, with one or two sureties in the like amount. 4/5
B)The applicant is directed to attend the concerned Investigating Officer on every Monday and Thursday, between 10:30 a.m. and 01:30 p.m. and shall co-operate with the investigation. C) The applicant shall not threaten, influence, or contact the complainant, witnesses, or any family members of the complainant, nor tamper with the prosecution evidence in any manner. He shall not indulge in any cognizable offence. Any single reported incident involving the applicant shall entitle the prosecution to move for cancellation of bail. D) The applicant shall furnish his residential address, contact number, and copies of his Aadhaar / PAN Cards to the Investigating Officer, and shall also provide the names, addresses, and contact numbers of his close relatives for the purpose of verification.

In view of the above conditions, the Anticipatory Bail Application is disposed of.
