Heard learned counsel for the applicant, learned APP for the State and learned counsel for the victim. 2.

It is a case of forceful sex with a girl of 15 years and 7 months. Out of the forceful sex, the victim was pregnant of five months and then the fetus was terminated. The applicant has a case that he has been falsely implicated in the crime. However, the DNA report is awaited which may go to the root of the matter. Therefore, leave granted to the learned counsel for the applicant to withdraw this application with liberty to file fresh bail application before the Sessions Court including the grounds raised in this application after the DNA report is received.
