The applicant apprehends his arrest in Crime No. 10/2021, registered with Shanishingnapur Police Station, Ahmednagar for the offences punishable under section 3 to 8 and 13 of Maharashtra Protection of Interest of the Depositors (In Financial Establishments) Act, 1999 and under section 402, 406, 408, 409, 417 to 424, 426, 427, 465 468, 471, 474, 109, 477, 477-A, 120-B, 107, 108, 110, 111, 504, 506 read with 34 of Indian Penal Code.

Informant/Depositor of Bhairavnath Multi-State Cooperative Credit Society lodged First Information Report alleging that his fixed deposits were not returned to him on maturity and Bhagyawant Punde

{2} 908-ABA-1387-2022 the Chairman, Directors and Manager of said society are responsible for the same.

Heard the learned advocate for the applicant and learned Additional Public Prosecutor for respondent. Perused the investigation papers.

Out of 12 accused persons named in the First Information Report, 8 accused/directors of the said society are granted protection by this Court. From the investigation papers it can be seen that the audit report does not show that there is misappropriation of funds. It appears that there was mismanagement in the society. In that view of the matter, the applicant deserves protection.

The application is therefore allowed by confirming the interim order dated 18th October, 2022.

Till filing of charge sheet, the applicant shall attend the concerned police station as and when called by the investigating officer and shall co-operate in the investigation. [NITIN B. SURYAWANSHI, J.] Bhagyawant Punde
